Hi all,
I will be filing for BR at the end of the week. Getting pretty nervous now and I am hoping some of you can help me to calm down.
About a month ago we setup an account with HBOS. Its just a EasyCash account with no frills. As far as I know they have nothing to do with any of the creditor that we owe which are:
Egg, Barclays, Barclaycard, Beneficial Finance, Marbles, Cahoot
Question is that if my pay and my wife's at the end of the week goes into our HBOS account will it be OK there for the BR? I have heard that accounts are frozen for a few days and to take out some some money beforehand.
That's the first question. I have tons more but thought I would start off gently ;)
Many thanks Subzuk |

Hi
It is ultimately up to the bank to decide if they will continue to offer basic banking services - the OR is just keen that you don't have a credit card / cheque book etc.
I would suggest you call the bank and ask them to confirm - WITHOUT giving your personal details.
It is quite important to get the timing right because otherwise although you will get the money back with help from the OR - it could take 2 weeks which will put you in a nind with essentials and rent,
Check it out first and if unsure change your date until after you have been paid.

Hi Reviva,
Thanks for the feedback. I will make a call to them and ask but without passing on my details. Would it be worth withdrawing my pay at the end of the week before going to the court to file for bankruptcy? Perhaps only leaving enough to cover any direct debits/standing orders?

Hi Needafriend,
Thanks for the tip. Kinda bricking it now as going down to the courts tomorrow morning. Just finishing filling the forms. One thing is that I withdrew 1300 a few days ago once my pay had gone in to cover 1000 for court fees and some living. That leaves about £200 in the bank. My question is, should I withdraw the 200 leaving say £40 in there? And do I list the money I have 300+200 as cash in hand? Or just tell the OR that it was for living expenses for the family?

Hi Jo,
So not list in in the cash in hand section. Just tell the OR during the interview? Thanks for the speedy response! On most of my debts which are 5 years or older don't really have a good idea of exact date so roughly guessing it. That ok?
I have a car valued about 1600 which is registered to my wife's name but I use it for transport to work and between offices. Hoping that will be safe.

Hi Jo, Yes we both are. Reason for bankruptcy is because we had a baby girl in September and wages are dropping substantially meaning that we only just have enough to cover bills/rent etc. We were going to head down the IVA route but were advised by the CCCS to go bankrupt as we would not be able to keep the IVA payments up.

Hi Jo,
Thanks for all your help. You have really been helpful in calming me down before tomorrow morning. Was going to ask about what to wear but have decided to aim on the smarted side. Have withdrawn the cash except 50 which I left in there. Crossed fingers all goes well!!
Will update you tomorrow
thanks subzuk |

Hi Jo,
Well went to court this morning about and as one of the staff were off, it meant that we weren't seen till about 11am. Then at 12.15 she brought us the successful BR forms! We didn't have to see the judge. I guess I will have to wait now until contacted by the OR. Already called most of my creditors and let them know.

Hi Jo,
Had a call from them today and we have a telephone interview on Monday one after each other. Pretty nervous now and I am sure I will have a ton of questions of the weekend. Will you be online over the weekend Jo? The papers say that I need to provide them with bank statements, wage slips etc.. Probably only got about 3-4 months worth and pretty worried that they might spot things I purchased when we moved in about 6-7 months ago like TV, Sofa etc... Especially as I put down that my total assets were about £250 of general household goods. My wife's mum gave us some cash to get the bits for the flat.
Anyway hope to chat over the weekend.

Hi Subzuk,
It would really depend on how much we're talking about here. Mt feeling is that is shouldn't be an issue.

Hi Julian,
Well TV we bought about 6 months ago cost about 450 and sofa about same time about the same. Both were bought using bank account and not credit cards. If I can't dig up all the statements I guess they can request them anyway?

Hi Sachie,
Given the amounts were talking about here, I don't think you'll have a problem.

HI all,
I know what the letter says that they sent regarding the interview tomorrow. But would like to know your experiences. What sort of things did they ask and what was the outcome of it?

Hi Jo
For my assets I just entered £250 general household goods. Will they dig into this deeper? Should I jot down how I worked this out?

Hi Subzuk,
Just relax and you'll be fine. All the dealings I've had with the Insolvency Service have been professional and courteous!
