 hi all we are going for br in january

hi all we are going for br in january and have not paid credit cards ,store cards and loans during november and part of october how long is it till baliffs come knocking should i pay something to keep them at bay had no letters or threats as yet but just worried sick at the momment

Hi

it is very unlikely that you will actually see a bailiff within those timescales.

You may get one or two creditors passing the debt to a collection agency who will write to you in the first instance. The letters tend to have a little more venom than those you will have received already but usually they will be blowing hot air for a while.

October being the first missed payment date and January being your planned BR date I would say you have little to worry about.

It's not a good idea to make any kind of payment to those creditors shouting the loudest as this could be seen as preferential treatment by the OR when they look at your case.

I agree fully with John. The time scale from missed payments to baliff can be a minimum of 4 months and in practice can be longer -if at all. A lot has to happen. The debt would have to get the county court claim stage(blue form) plus a forthwith has to be ordered by the district judge. The claimant would have to take enforcement action which would have to include a Warrant of Execution (which is need for a baliff to enforce the debt)

So if you are looking for a January BR date you should be fine.

I would phone the county court and ask the bankruptcy clerk what available dates there are. For some courts we were given January dates when we called in November !!!

also we are moving into rented this week and handing the keys back on our home so i guess they will have to find us before we go bankrupt we do not have anything of real value at all especially when we have four boys to feed just sentimental bits i am a hoarder of nic nacs and the or and baliffs scares the life out of me every day i wake up and think am i still going through this the only that keeps me strong are my children and family and i count my blessings we are all well and at the end of the day this is just about money we will get over it and our downfall was out of our hands due to my husbands business but you live and learn
