As our IVA has failed do we have a choice of going bandrupt? Is it not possible to take decision away from IVA Company and sort it out ourselves with the ~Creditors?

Hi Pat,

If your IVA has failed then the supervisor of your IVA would inform the creditors, predominantly it is down to your creditors whether they instruct the supervisor to petition for your bankruptcy, so it may help if you wish to negotiate with your creditors directly.

The creditors can stop the supervisor from petitioning from the Bankruptcy if you come to alternative arrangements with them.
