Hi

My car is on HP with GECapital, I noticed last night when I was photocopying the HP agreement for the courts and or that it states "if you enter into an IVA and/or Bankruptcy we may cancel this agreement" Although I have been in two IVAs before but never informed them, would it be best practice to inform them of the Pending bankruptcy?

Hi Stu

I think i helped answer this question earlier today but if i were you and i did this i called the finance co and informed them, i seem to recall you sayin that you may wait.

I do think it may be better to ask them out right if you can keep it, to be honest it may be ok anyhow and you could be worrying over nothing.

Thanks Jo,

ive got a memory of siv, must be the depression, ive been offered an interview on monday in my local gym for a sales job coomplete change.

Ive just worked out that my car costs me around £300 a month this include HP, Petrol, provisions for tax/service and insurance so may be a good thing if I lost it. Not sure though.

Also told my mum im going bankrupt and she is unhappy thinks I should do a 30 year DMP instead,

Do you think I should surrender the car, and go BR?

Hi Stu

It is up to you, i would keep it until such time the OR says either way or the finance co say about it.

If its costing too much then it may be an option but if you dont mind it going stop paying for it and let it get repossesed. If you do let it go back you need a letter about the amounts owing to give to the OR when you go BR, i would just try and keep it for now if you want too.

I would keep it for now if you can but can you live without it, can you get to your job etc.

As for your Mum she is concerned about you, she also prob thinks about the old bankruptcy system, tell her what you tell us, you have thought it through and feel this is now your last option.

Hi Jo
the agreement states "we may terminate this agreemetn after giving you written notice if... Any important information you have given to us is incomplete, untrue or fraudulant... you die, become bankrupt or enter into an voluntary arrangement with other people you owe money too"

Looking at the agreement they have spelt my name as Stewart not Stuart, and therefore wont be able to credit score me appropriatley.
I dont want to get done for Fraud or falsification of documents due to my name and not disclosing the IVAs and either the BR or DMP

Please advise.

You wont get done for fraud, its a genuine name mistake and also they put these clasues in to cover their backs.

I would though if you do want to keep it continue with the payments if you want it to go stop the payments. If you are at all worried the only other way is to call them and ask but at the end of the day do you want and need to keep the car?
