WE JOINTLY OWN A DUPLEX WITH MY HUSBANDS BROTHER. THERE IS NO MORTGAGE. HE MAY FILE BANKRUPTCY. CAN THEY TAKE OUR PROPERTY FROM US? WE DON'T WANT TO SELL THE PROPERTY. IT IS SUPPOSED TO BE OUR RETIREMENT UNIT.

Hi Mebubbys and welcome to the forum.

If your husband's brother files for bankruptcy, his interest in the property will need to be realised for the benefit of his creditors. If the property is owned unencumbered, it is likely the Trustee will force the sale.
