 i have now missed two payments as told by my ip

i have now missed two payments as told by my ip.can my creditors ask bailiffs to visit my house??

Hi barbra and welcome

Not without them going to court first can they send out bailiffs to take your goods, they have to go through the proper channels and procedures before they can suddenly come to our door and take stuff.

If you intend to go BR then you need to miss a minimum of 3 payments before any IP will start the bakruptcy procedure.

Is this what your hoping to do as it may be worth giving the helpline a call sometime and see if they can help you at all.

Just to confirm

If you are currently in an IVA then you have legal protection from action from your creditors. They cannot take any action ( not including current new debts) and are bound by the IVA.

In order to petition for Br you would need to miss 3 payments and have a letter or certificate from the IP to present to the Court with your SOA confirming that the IP is aware that the IVA is failing / has failed etc.

Have you tried to speak to the IP regarding the IVA payments to see what they can do. They may be able to present a variation with the creditors for you.

Depending upon your circumstances and how long you have been on the IVA would depend on the next steps.

thanks for that paul,i did ring them but at the start the payments went up£40pcm as my wife has two dogs insured!i asked if i could reduce the payments but was shown no mercy!i guess br is the only way up now.
