Hello,,
Does anyone know if a bankrupt can be put on a Nil Tax Code IPA and, even though his/her circumstances have not changed from those which were assessed for the Nil Tax Code IPA, be later upgraded from a Nil Tax Code IPA to an IPA of a higher amount and for the full 3 years instead of just for the remainder of the current tax year?

you must be in the standard (non NT tax code related) before discharge or it will be too late for the OR to propose one.

If someone is at the stage of being in a Nil Tax Code IPA and just submitted their IPOQ for possible early discharge and their circumstances have not changed is it still posible, then, that the examiner (or the collecting agent?)could query the IPOQ figures again even though they have already seen the same figures on the original SOA and say they want an increased IPA? In other words, could they - or would it be likely - change their minds and press to increase the payment?
Maybe someone on the forum has first hand experience of such a thing happening? |

Hi
in theory you would assume that if there is no change to I&E that all will be well.
However, as we know, the figures are subject to the interpretation, and mood I guess, of the examiner dealing with your case.
I have seen circumstances, but admittedly only a few, where a different examiner deals with the IPOQ and has different views on allowances.
As I say, the percentage is very low so the chances are heavily in your favour that all will be well.
