I have a car on finance from welcome finance,i havnt paid it scince nov 2007,i have never had a letter or phone call from them,then to day i got a letter from a debt collection agency demanding 9,500,so it seems welcome dont want the car back, does this meen the debt collection agency can reposess the car,i intend to make my selfe bancrupt but cant afford the fees just yet,i am hoping that the dept collection agency will make me bancrupt,and if they do can the or make me sell the car as it does not belong to me it belongs to welcome finance,

Hi

the OR won't make you sell the car as it is not yours.

It is also unlikely that Welcome - or their agent - will make you Br. They are more likely to pursue you through the courts for the shortfall . This would include CCJ's, attachment of earnings, bailiffs etc etc.

If you have paid more than a third of the total payments then they cannot reposess the car without a court order.

hi, i already have 2 attachement of earnings on my wages,,and bailifs already have a walk in possession for unpaid council tax,i hav'nt paid one third as yet,i wonder what would happen now,

I think the car is the least of your worries.

If you believe Br is the right solution then you need to find a way to fund the fees otherwise the bailiffs are legally able to re - enter the property and remove the goods

the attachment of earnings will cease as soon as you are Br as will the hassle from bailiffs and Welcome
