hi i had a motorhome on hp from black horse and could not afford the payments so they took it back they have sold it and have sent me a letter telling me that i have to pay just under £1800.00 which i cant afford if i go br will this be able to be included and will are overdraft be included we are on income support with 1 child how much would it cost me to go br and what information will i need to provide
you will need to contact the county court that you will be declaring bankruptcy in to establish what they accept as proof of benefits and how you can claim a reduced payment (waiving of court fees). The full fee is £495 but reduced to £345 if your application is successful.
The overdraft and shortfall on the motorhome would indeed be included in your bankruptcy.
Yes your motor home debt should be included but is it single or joint.
Also your overdraft is that single or joint.
Any joint debts that you have would mean that the other non bankrupt party would be liable making it joint and several.
What other debts do you have and also do you have any other assets.

To clarify Jo's point, joint borrowings are what is called joint and several liability. In essence, this means that both parties are liable for 100% of the debt, and the first one to pay wins!
