Hi all,

If you've read my "what a mess story" you will know my situation.

The question i have is i left my family home last october and paid 6 months rent in advance on private rented appartment which is of course up in April, i am probably going bankrupt soon. Am i best to pay (if i can get hold of the cash) another 6 months up front before going bankrupt so i can stay in the appartment,or not and hope for the best. Will the creditors try and claim back the money i have paid to the landlord when i am bankrupt.

Just not sure best way to deal with this to ensure i do not lose my appartment as i understand it will be very difficult to get a new one during bankruptcy.

Please advise your opinions are very welcome and much needed, this forum is becoming my salvation.

Hi Sott1967 - If you have already secured your rented accommodation and currently living there, why can you not continue to reside there paying monthly rent? you have already passed the 'credit check' when you took on the tenancy you sould be able to just renew your lease or indeed just continue paying your rent on what is temred a 'rolling lease' by remaining in the accommodation.

By the way snow is thick here and looks lovely outside my window, but unfortunatley am too busy to go play in it - will venture out luchtime though to walk my dogs

Melanie,

thanks for getting back to me.

my worry with continuing paying dd monthly is what happens when the bankruptcy takes place and my bank accounts are frozen, would it not be best to pay 6 months up front so the land lord does not become aware of my bankruptcy, or am i being naive and he will find out any way. In the later case what if he does find out what is he most likely to do ?

You will need to open a new basic account on either prior to or following filing for bankruptcy, (unless your present account is in credit with no overdraft and not linked to any of your creditors)
Your landlord will be written to as part of the bankruptcy anyway, standard proceedure for OR's to write to landlords, I usually ask clients I deal with to speak to their landlord prior to filing just to do the courteous thing and let them know. This does not usually have a negative affect on your tnenacy all the landlord is concerned over is your payment history - as long as your rent has been paid as and when due you should not have any difficulties - I just personally feel it is beeter for your landlord to find out first hand than from the OR

Hey Scott

I Just wanted to add that i also think that in this current climate landlords are being very understanding of people's financial situaions.

They would rather someone who is allowed rent in with the budget, rather than someone living off credit to be tenants. More and more people on the site have been telling landlords in recent months and its had a positive effect

Hi ya .... just had to add that today I told my landlord about my BR next week.
I was ABSOLUTELY petrified .... my voice was shaking as I was talking, and I had NO idea how he was going to react ... and you know what ... he was BRILLIANT!
He said ....'As long as the rent keeps coming its not a problem for me!' ... can't tell you the relief!

any one heard or experienced horror stories hear ie as soon as landlord finds out your bankrupt he kicked you out and if so how hard did you find it to get a new place.

I think you should be fine - i dont think landlords can be too picky in this market anyway. You have paid your rent on time since you lived there, so i cant see why there would be a problem.

Can you make an anon call to landlord to find out their 'policy' on br's ?

Hi there this was a scenerio I was concerned over myself. I sold my house last year and could only find a local property with a letting agent and due to having adverse credit I had to pay 6 mnths up front as I did not have anyone to guarantor. My husband is disabled and the only property available at the time that we could afford was a 3 bed house, I have just found a bungalow that would be absolutely ideal and we have been told that the landlord wants to let it indefinately which suits us and our 4 children. we are having to pay six months up front again as a condition of the landlord and have been told they will want six months again at the end of that six months. We are leaving our current let home early by 5 wks as I am worried we will lose it and that it will be a problem after the bankruptcy. Will the OR take in consideration that from the start of the tennancy I am having to accummalate the next six month ready and Will he make allowances for this within our expenditure. Any comments would be sincerely appreciated . I have had a reply on a previous post in regards to this but I am wondering whether the OR will understand us leaving our current place early especially when we are paid up till next month .
