Hi it looks like a company is going to focr bankruptcy on me...i was wandering if i am married will this affect my wife?she has no assets etc and basically just earns enough to pay for her bills loans etc..its just my name on the debt and i had the debt before i was married any ideas?

What action have the company taken to date regarding Br?

It is quite common for creditors to suggest Br in the chasing letters, as well as charging orders, attachment of earnings, damaged credit files etc etc etc.

It is far less common for a creditor to actually petition for Br. This is because it can cost them up to £2000 and there is no guarantee that they will get any return.

In order to make you Br they will need to serve you with a Statutory Demand. This allows you 18 days to dispute the debt / defend the petition. After 21 days they are able to petition for your Br at court.

I would recommend you either phone the helpline ( number above) or one of the site experts who can then spend some time with you on the phone ( free of charge) so that you fully understand your position.

It will effect your wife's credit history unless you file a notice of disassociation with the 3 credit reference agencies.

Im sure once you have had that initial call with someone things will become alot clearer to you.

As Paul says you could contact the Helpline or why not try Paul himself. Either way you are certainly going to get great advice.
