Who and where can I talk to regarding my situation? I have defaulted on an IVA because I cannot make the monthly repayments. My debt has gone up since the IVA was put into place. 4 creditors I had forgotten to include in the IVA are now contacting me wanting payment. Should I now seek help with bankruptcy? Your forum and information sites seem to say that's my only hope.

I am sorry to hear about your IVa defaulting and the stress that you are experiencing.

It would be helpful to get a little moe detail before we give advice regarding your situation.

How long have you been on the IVA
What was the initial debt within the IVa
how much do you pay per month
what do you do for a living
do you own your own house - if so please give details on mortgage and value etc.

this wil give us somewhere to start -however if you need to speak to someone rather than use the forum there are a number of debt experts who will give free advice via our web links

How long have you been on the IVA
3 months and I have not made any payments at all.
What was the initial debt within the IVa
20k now more like 26k
how much do you pay per month
I haven't been able to make even the first payment. They won't reconsider a lesser monthly amount either. (they initially wanted £450!)
what do you do for a living
At present I work as a receptionist/Front of House for a firm of solicitors. (I work as support/admin only and have no legal training)
do you own your own house - if so please give details on mortgage and value etc.
I rent my flat.

I'm not worried about the bankruptcy being made known in the press, I'm worried about my job!?

Hi zchr1

bit confused by the monthly contribution amount of 450. this would pay 27,000 over the 5 years so unless your iva is for shorter then I must assume the debt was for 27k or more.

If you have no assets then obviously br is a viable option and as you haven;t made any payments yet your IVa stands a reall chance of failing very soon.

It would be good to check your employment contract to see the terms re Br, but it is not a standard that you would loose your job at all.

There are certainly jobs that ar not allowed to be conducted whilst in br and yours is not one of them. I would assume that if your employer is worth their salt they would be sympathetic to the situation and work with you rather than loose you and enjoy the cost of recruiting, training and implementing a new member of staff.

You would be surprised by how helpful employers are. On occasions my clients will actually approach the employer for assistance with insolvency fees and he employer is only too happy to help.

There is a posibility that you may have an income payment agreement - where you would pay back a percentage of your disposable income - for a period of 3 years. But if you are struggling to make the IVA payments then it is likely that the current I&E budget is too onerous and probably a little too unrealistic.

So what would you recommend I do next? Should I find an IP like yourself and start again. I can't afford IP fee;sso am at a loss of where to look.

I'm trying to find out what court Iam meant to go to, in order to deliver my application for bankruptcy. I live in London, SE22 0HF. Can anyone suggest where to look. I've been on the Courts website and I have no idea which court applies to me. If there is a choice I would prefer not to go to the RCJ on The Strand as it's far too near my work!

the high court is The Royal Courts of Justice on the Strand.

It is a huge place inside so unlikeley that anyone would see you

Paul's absolutely rightI wouldn't be too concerned about bumping into somebody there it is huge. However here is a funny story - I was outside RCJ a little while back with a client - he was having a cigarette before we went in and then a hoard of photgraphers and camera crew turned up - they were only tracking Mohamed al-Fayed as he was seeking the opening of the Diana Inquest.

My Client was intially concerned that he would be seen and then when not shown on news at Ten disappointed.

He is now discharged from bankruptcy and the Diana inquest continues

The message really is - if it's right then it's worth facing up to

Thanks for the info. Do I just ring them up, ask for the forms and ask how to set the date? Going to be a struggle to get the fee's Iknow that much. Can I pick the formsup in person.Better than printing them off at work.
