We are just about finished with our SOA for court on Thursday, but my partner is unsure as to whether to put down the mortgage company on the house he co-owns with his ex wife as a creditor.

He has hasn't lived there for 6 years and has paid nothing towards the property in either mortgage payments or upkeep.

His ex wife has kept up the mortgage payments and has never been in arrears, but my partner is still on the mortgage and deeds.

Does he put it down as a creditor or not?

Hey Elle

As long as he is listed on the mortgage then im sure he will need to put it down. He will get chance to explain the situation to the OR.

Hope it goes well for you both on Thursday, please keep us updated how you get on

Take care

Jenny

yes the details need to be listed 3 times in section 3.1.9 or 3.1.10 depending on the property being leasehold or freehold, in section 4 (secured) and finally in section 8.1.
