After thinking that I had no more questions to ask about my forthcoming bankruptcy, I seem to keep coming up with reasons to worry. Several of your posts mention that the judge asks if you have taken advice. If you haven''t is this a problem. I looked at all the options, considered IVAs, DMP''s. I already had informal payment plans set up with my creditors. It was only after my partner left that I couldn''t pay. As I see it, I have no disposable income at all so bankruptcy seemed like the only route to take. Do judges have a problem with people who haven''t taken professional advice?
Not at all - they are just asking to ensure you have not entered into this process without giving it the thought such a step warrants. They want to ensure you did not just wake up one morning decide to bankrupt and filed....as if! .... most worry for months and it is usually a final resort after trying other options first. At then end of the day if you have debts you cannot afford to pay for what ever reason, you are insolvent and bankruptcy the possible answer, advice is required (even from a site such as this) to ensure if you have a property the possible implications.
