Hello, reading through the posts i wished i'd found the forum earlier.

I have recently had a charging order placed against my home, a creditor is chasing me for £4000 and i was paying this through my IVA company (CCCS) up until i moved into the property 12 months ago. I have numerous other creditors. This debt was passed on so payments stopped and i was never informed who it was sent to. CCCS advised me to sit tight and wait for the new company to contact me. In December, i had a letter from a company called TBI who advised that since i had not been in touch with them, they were going to press for a CCJ. I passed their details to CCCS, who duly advised they would arrange contact and payments. In January i had letters form TBI saying they would not accept payments and that they still intended to apply for CCJ (which they did) and also a charging order (which they now have as of yesterday). Thing is, CCCS have paid TBI for January and February.
Understandably, i am now worried this company will force me to sell me lovely new home, which given my circumstances took a lot of time and effort to secure. Please Advise.

Hi there can you please clarify as i am a bit confused with your statement. Are you in an IVA? as you state or a DMP?

The answer has important implications as to the response i would give you

just to add, have had a letter from TBI's solicitors today, explaining that the charging order has been secured and is inviting me to respond with proposals for repayment
