i was made bankrupt in july 06, so am now discharged. was told to make payments every month for 3 years. i have been paying but am struggling, is there anything i can do?

Hi jacko
you need to discuss directly with the official receivers office.

best thing to do is look at your income and expenditure at the time of Br ( shown on your form) and prepare an up to date one - this will identify the changes ( i.e. drop in income or increase in expenses )

armed with the info this would be grounds for the IPA to be reduced to what works for your situation

The Official Receiver's offices have sub-contracted the collection of IPA and IPO payments to Clarke Willmott Clarke - a relatively well known firm of specialist insolvency lawyers. The OR might direct you to discuss this directly with this firm, but at the end of the day if you can't make the payments, and this can be proven, there is very little which can be done to enforce the order against you.

I was told that if I needed to make a change to my IPA payments I would need to contact Clarke Willmott and they would send me a new I & E form. This would then be reassessed by the OR.

BTW, don't worry about contacting Clarke Willmott - I have had to speak to them on a number of occasions and they were great, really polite and efficient.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
