Hello,

I have just started filling in the forms to petition for my bankruptcy and have a few questions I hope someone maybe able to answerer.

1, I have a list of creditors from my IP 5 of the creditors say Max recovery Ltd but they should say Halifax, visa, etc..? Do I put max recovery on the list of unsecured creditors if so does anyone have there address?


2, I suffered debts due to gambling and simply overspending and this has been documented in my Iva, should I put this down on The bankruptcy forms? also what are the consequences of this?

You put down Max Recovery as they now own the debts. Their address is below:-

Hi,

One more thing it also asks for: Date incurred & What was the debt for? is this the date of the original loan/credit card or when max recovery took over it? and as for what the debt was for, hellllpppppp!!!! I can't remember what I spent yesterday never mind a few years back..

Hi John,

The date is the time at which the loan or credit card was taken out.

As far as what the money was spent on this is an important part of the Bankruptcy process as the OR will get a picture of how and why the debts were incurred so try to remember the best you can.

Remember a proportion of the outstanding will be interest and charges against your borrowing.

I would start with the larger debts first as you should be able to remember some of what this was spent on.

Have you any large credit cards perhaps ones which offered low interest rates that may have been used to consolidate earlier debts?
If so start with these and work backwards.

Were you subsidizing your income?
If your income vastly exceeded your expenditure then you can mention that.

Were you using credit cards to support other loan or card payments and robbing from peter to pay paul?

A few ideas to hopefully get you started.

I was told that I should put the name of the original creditor and the address of Max Recovery.

I put general living expenses as the reasons for my credit card debts, and debt consolidation for the loans.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
