I am looking at filing BR in the next week or so.

I moved in to my girlfriends house about 2 months ago she is solely named on the mortgage, as she is part time at work and looks after my daughter when I am at work I pay £500 a month towards the mortgage. I have been told that because I pay towards the mortgage this shows a financial interest in the property.

Can anyone tell me if this is true and if it is how I can put this down as an outgoing without it being taken as a financial interest.

Hello Shylock

You don't have any interest in your girlfriends property - you do however contribute towards the household expenses ( roof / food / utilities) depending upon what you earn each month could also mean that you have an income payment agreement which means thay you would need to pay a percentage ( between 50 and 70%) of your disposable income each month to the OR for a 3 year perios.

Do you have any assets such as a car etc?

I have a car but its only worth about £1000 and I need it for work I live 20 miles from where I work and I work rotating shifts so public transport would be very difficult for me to use.

After paying all my bills and house hold expenses (fuel for work etc)and child support I only have aboout £100 left

Your car will be safe as you can have a vehicle valued up to £2500 in Bankruptcy.

If you have around 100 left then you would probably get an income payment order of around 50 per month.

Worth double checking that you have covered allyour costs and the ones you have included are allowable in Br

If you have only lived with your partner for the last two months, the Official Receiver would have no grounds for claiming a beneficial interest in her property.

I suspect that your disposable income will eventually be lower than £100 - do make sure that you provide for contingencies, and even holidays as some OR's offices actually allow such provisions. I doubt whether an Income Payments Agreement or Order would be appropriate in your case.

I had lived with my partner for a year when I went BR but had only been paying anything towards my 'keep' for a couple of months. The OR never mentioned my having beneficial interest in the property, presumably because of how little I'd paid.

Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.
