I don't know your individual circumstances but as with the court hearing it isn't as bad as you think it will be as long as you have all the information you need and you are honest in your answers.

Hi Had my phone interview this morning and I ended up in tears !! I just couldn't answer where all the money had gone other than general monthly expediture supplementing our income. When I was told the figure of what the extra monthly expenditure looked like that I had spent I just can't understand how I managed to spend that much. We haven't had a holiday for 4 years, we don't go out much, all I have been doing is buying food shopping and the odd meal out possibly one a month. I have remorgaged a couple of times for consolidation and ended up using the cards again. It has now been passed to a higher officer. I'm very worried about what the outcome will be, I suppose the worst case scenario is a 15 yr BRO. I just need a hug !! I have certainly learnt my lesson.

BIG ((((((CYBER HUG)))))))on its way via the internet to you, sorry to hear you got upset when talking to the OR - you won't be the first or the last so try not to let it bother you too much. With regard to your debt levels, try to look at how much interest and charges add up to...and in reality you won't have spent anywhere near the outstanding balance, particularly if you have taken out consolidation loans as these will have the interest and charges that have been put on the cards plus the interest and charges of the consolidation loan so double the whammy!! All case files get referred to the Assistant Official Receiver, for a final decision.overview, so don't get too alarmed, you are not being treated any differently than anyone else nor you will not be treated more harshly than anyone else, Unfortunately it appears you had a bit of a jobsworth as an examiner, unfortuately there are some of them around. Try not to worry too much, though i guess this is a bit of a silly statement at the moemtn as you are probably worrying yourself bigtime - there really isn't any need. Go have a coffee and try above all to relax, nothing you now do or say is going to make a blind bit of difference. You know where i am if you need me, Melanie

Thanks for your kind words xx I 'm worried that if I can't tell them what ive spent the money on they will think that I have gambled it away which I haven't. The nearest I get to gambling is £2 on the lottery every Saturday. I keep looking at the figures and can't beleive its mounted up to so much. I think his main concern was that I had re mortgaged and took out loans for consolidation and used the cards again. As you have said, interest charges etc do add up and when broken down will not be as bad as he is saying. My Husband also has gone BR and will be getting his call soon. Do you think they will ask me in to the office to try and get the reasons for the expediture? I hope not. The or's office have all my last 12mths statements so I can't understand why they didn't look at those.

Hi Don't worry too much - we took out a £7000 overdraft in November and I can't account for that other than to say it went on rent, food and day to day living - think that may be an interesting conversation with the OR

Sorry to hear you had such a bad experience wellerchic, but at least its over now. I'm sure everything will be fine in the end and try not to worry in the meantime.
I have had a couple of half hour interviews by phone with the OR, although not the 'big' one lasting for hours as i had been expecting. So far it seems okay and although I too was dreading the interview, it seemed to go better than I expected. The questions the OR asked didn't seem too probing, just how much debt I had, how much I had spent in a period of time and how. I was completely honest and although I didn't know exactly how much I had spent, I told her approx £15,000 had been spent on gambling amongst other things. She didn't seem judgmental, although not exactly over the moon either. I will definately get a BRU, but for how long I don't know yet. Saying that, I did go over my statements last night and it was a real eye opener and didn't make good reading to be honest. I knew I had spent a great deal of money over a short period of time between July and November last year, but actually seeing it on paper made me feel sick. I must have spent nearly £15,000. How on earth can you do that? Well I did and I am not proud of the fact and even to this day, I cannot believe I have spent this amount, but its there in black and white. The OR did ask how much I think I spent in an average night out at the casino and I was honest with her and told her the highest figure I had ever spent in one session. Whether this will have a bearing on the length of my BRU, I am not sure. I did say to her that I was worried I may get 15 years, to which she replied, gambling BRU's are usually around the 2-4 year mark.
We'll just have to see.

I just want to get my statements back from the OR office so I can look again because I really don't know where its all gone ! My husbands opinion is expenditure goes up and wages stay the same or go down !! But that doesn't give the OR an answer !
Its done now so maybe I just need to "chill" as my Daughter keeps telling me

Hi Wellerchic Just wanted to say that if all of us forum members were the sort of people who kept track of our expenditure, we wouldn't be on this site, we would be counting our pots of money. I am sure the majority of people the OR speaks to struggle with explaining away their debts. I know I'm going to... x

The strange thing is after a good nights sleep things keep popping into my head what I did use the money for, not big things just things like a bit of fencing in the garden, clothes for the kids etc. As Melanie said a lot of it was probably interest. I remember once out of a £100 payment to a credit card only £22 was paid off the debt the remainder was interest. I have got past the hardest bit now just want to look forward to a debt free future.

I had to really think what I had spent my money on, but as you mine was shopping, clothes for kids, running car, just daily expenses. I know when I had my phone interview, I really thought the OR was trying to catch me out, as he kept repeating what I had said, then he would ask me the same question again about 5 minutes later, trying to change what I had said, he did not speak very good english and that was when I realised he was actually trying to help me. So dont get stressed what will be will be. |
