HI
I am saving up for the fees to apply for BR ,i estimate that i will have enough money in approx 5 weeks time.
My question is ,should i stop paying my creditors now as i am struggling to meet their payments ,and would any action they may take beat my application for BR in 5 weeks time.Some are threatening me with court action etc to secure unsecured debts to my property

Hi

firstly you should check the waiting list at the court where you will be petitioning.

If it will take 5 weeks to save the fees don't assume you will get an appointment within days. Some courts have a 2 month back log.

If you are being threatened with charges against the property this would normally indicate that you have not been paying anyway. That said some collection agencies are somewhat over zealous.

If you have paid up to now, check the waiting list length and make the appointment, then stop paying once you have but 6 weeks or so before the appointment. The process to apply a final charging order would take too long.
