Well I had a very nice surprise on Saturday morning. I had a letter from my OR saying please find enclosed a sealed copy of Form 6.82 - Notice under Section 279(2) of the Insolvency Act 1986 for your records. Your date of discharge from bankruptcy is the date the Court sealed Form 6.82 which is 20th March 2009.

Pursuant to Section 279(2) of the Insolvency Act 1986, the Offical Receiver states that the investigation of the bankrupts affairs is unnecessary or concluded.

I have been given EARLY DISCHARGE!!! Woooooo Hooooo!

The weird thing is that I never filled in an updated I&E form etc. I didn't even know I was being put forward for early discharge!

I thought the procedure was that I filled in an updated I&E form, this has to go to the creditors to agree then to the courts. I seem to have missed out all this!

I received a updated I&E form even though I am still out of work since last year and my circumstances remained the same - unemployed. It does seem they follow different procedures for different cases. Will see what happens in the next 2 months if anything.

Hi

often a case is so straightforward the OR takes a view that any investigation beyond the mandatory checking of Land Registry and DVLA records etc would be at a cost to the insolvency service which could clearly not be recovered.

Yours appears to be one such case.

Many thanks John.

I do still have an IPA to pay but Im fine with that. Im am no longer classed as bankrupt which actually feels great especially as it was so unexpected!
