I am currently 2 years in to an IVA and started maternity leave in February. I have constantly tried to speak to my IVA company about reducing payments and get told so many different things and they never call me back.
Unfortunately my baby was born with a heart defect requiring open heart surgery when she was born. She is on medication which now means that I am unable to return to work for the hours I had planned. There is no way that the IVA company will allow me to go from paying £559 to £100 per month and I feel my only option is bankruptcy.
My house is in my husbands and his fathers name although I have paid him 'rent' since moving in. Will my bankruptcy affect the house we live in as it is not my house and I have paid no deposit towards it?
so sorry to hear about your little one's heart problem. Rather puts money challenges into persepective.
Also sorry to hear that although you have worked hard for the 2 years in the IVA you may need to contemplate Br.
Couple of things
1. You need to get sepcific advice from an expert regarding the property because there is a possibility that the OR may consider you have an interest. This depends upon a number of things.
2. definately worth speaking to the IVA company - not the telephone people but your IP - and discuss the options with them. The telephone folk will be of no help you definately need to speak to the IP because your situation has dramatically changed and they may be able to approach the crediotrs with a proposal that works.
3. If you eventually decide that Br is the right course for you then you need to have the IVA fail and get a letter or termination from the IVA company. Most courts in the UK will not process your BR if you are currently in an active IVA.
