Trustees Cost
My husband went bankrupt while the divorce proceeding were going through. I'm buying my husbands share from trustee and we have negotiated the price of the share. However the trustee now is demanding for their solicitors costs to be paid by me. I'm disputing them as the cort order did not enforce them upon me. They applaying for cost assessment.On the other hand soon to be x husband is unempoyed and on benefits. As he is the one who is bankrupt can't the court asks him to pay for the trustee legal cost as he is entilted to legal aid?. Any thoughts will be appreciated

Hi

The Trustee has you over a barrel here really, if you don't agree to pay the costs he can just go for repossession of the property. It is a little greedy for ask you to pay their solicitor fee also, especially if they are able to pay them out of the estate anyway.

Thank you Suzanne,

The trustee also said that I will be responsibile for the cots assessment. Can they do that? We did agree on the share but then they wanted their solicitors fees to be paid too, by me. I'm student and mother of two and cant afford every charge on earth that trustee wants. Now they have sent application for possession order. The court is notified about my offer and dispute regarding trustees solicitors fee. Would they be sucessfule in gaining possession ordrer?
