My partner and l are disabled and in receipt of benefit including DLA, recently our financial situation has become dire and l see BR as our only way out, lm wondering if there is any way we could keep our estate car which is used to transport my electric wheel chair, without the car l would be virtually housebound, could my disability be taken into account or would l need to be seeking employment to keep the car, lt probably seem that l want to have my cake and eat it but if l lose the car we would suffer a great deal of hardship.

Hi,

I presume you are in receipt of the higher rate mobility allowance? Could you get a motability car?

That way there would be no worries about a car. I assume that as you need it to get about, then there wouldn't be a problem with you keeping it unless it is worth a lot of money.

I'm sure one of the experts will advise further.

Hi Kallis3 thank you for the quick reply, yes l receive the high rate of mobility,l estimate the car l have to be worth around £2000 unfortunatly l wouldnt be able to apply for a mobility car as l only have 2 years to run until my DLA is renewed for a car you need to have 3 years l could appeal and have my DLA extended but the process can take many months. l should also mention that l live in scotland, dont know if the rules are different?

Hi Spence,

BR in Scotland is different that in England or Wales and is known as Sequestration. There are also different guidelines as to declaring BR in Scotland - http://www.nationaldebtline.co.uk/scotland/factsheet.php?page=01_bankruptcy.

It may be best to look at the link above and see what the process is in Scotland.
