Hi,
Is it always the case that your name is printed in the paper when going bankrupt? Which paper is it?

Hi Ian and welcome to the forum.
When you are made BR your name is printed in the London Gazette and your local paper.
Tomorrow is a mystery, yesterday is history, today is the present, a gift to make the most of.

Hi there
The information is published in 4 places
Stubbs Gazette & The London Gazette - subscription only for insolvency professionsal. You can't buy these at WH Smiths.
It is also on the insolvency.gov website but you need to know where to look.
It is also advertised in your local paper. Quite a small advert. I would encourage you to buy the paper for a week and see if you can find it. Most people don't read that section.

A lady posted here this week **, who was being made bankrupt as a result of a failed IVA, and managed to avoid the public advertisement by negotiation with the judge. This is an interesting development, but worth a try for anyone in the same situation.

| Hi, thanks for all the help. I only asked because i actually read that lady's comment about paying the £30 to avoid it being published in her local paper and wondered if that was just a one off or a regular thing that can happen ? |

Hi....I am that lady!
It took some courage to ask but as I have been in an IVA for two years and it's "old news" to my creditors I thought he could only say no!
The judge had a discussion with the court clerk and she informed him of the cost so its not a frequent thing by the sounds of it. I have to admit I was dreading it going in our local paper as I live in a small town and theres no way it would be missed. |

Yes i live in a samll town myself and would feel awful due to my parents reading the paper every week.
Did you ask the question at the start of the proccess or was it right towards the end ? |

I know exactly how you feel....my parents run a small business in same small town. It would be horrible.
I asked at the end - the judge asked me if I had any questions so I said.....is there anyway of stopping it being posted in the local paper? I have been in an IVA for two years and any creditor I have knows of my insolvency.
He said he would order that it not go in the paper.
He asked the court clerk if there was any additional fee involved for a second court order - she said yes - £30. Worth every penny!
You can only ask - I know I came across very distressed/embarrassed and he was very kind.

As I said in another post i think you will find you will be in the London Gazette
about two weeks after yur bankruptcy order date go to this internet link
http://www.gazettes.co.uk/home.aspx?geotype=London
click on 'Advanced Search'
then, under the 'Date Search' field fill out the 'On/from' dates for the period during which your bankruptcy order took place.
finally, under the 'Words' field type in 'petition' for 'With all the words' and your surname (space) first name for the 'With the exact phrase'. click 'Search' and it should find your bankruptcy details from the relevant London Gazette copy.
Of course, not many people know that, as Michael Caine would say, and therefore people in your local area probably won't check it. Nevertheless, it is possible someone might.
My uncle's bankruptcy for 1980 is on there! I have followed in his footsteps and I am on there.
What worries me is whether - 20 years after a bankruptcy - the mortgage companies would look on there even if a mortgage application form did not specifically ask if you had ever been bankrupt. i suppose they might look even if you yourself had 'forgotten' a painful experience.
