i am in a lot of debt and i am on state benefits which means i am struggling to live on that money nevermind paying me creditors aswell, could you please advise me of the best course of action i should consider

If you don't have a likely chance of employment in the near future then BR may be the best option. As you are on benefits you won't be subject to an IPA so will be able to keep your benefits.

If your debts are lower than £15k then a DRO (Debt Relief Order) would be a better option and more information regarding DRO's is available from the CAB.

If you are on certain benefits you can get the court costs waived. In Wales the full cost of BR is now £510. The court costs being £150 of that total sum. Because I was on guaranteed pension credit I had to pay £360. So if you consider bancruptcy ask for the court waiver form. sorry cannot remember what it is called.

That's the full cost throughout England and Wales. Not sure about Scotland though.

As gettingoutofdebt says, if your debts are less than £15,000 you could consider a DRO - CAB can advise on that.

If it is bankruptcy you are going for, then ring up your local court, I am sure they will tell you what the relevant form is.

The form is called an EX160
