Hi I have another couple of questions if anyone can help. If a creditor has a AOE order set up against you before you apply for BR will the AOE be caneled when you are made bankrupt. Also my mobile phone costs me £40.00 a month and my sister also has a phone on under my name which she gives me the money for her bill each mont, will I be allowed to keep my contract with vodafone? |

The AOE will be included in your BR so don't worry about it.
There is no problem with you having 2 mobile phone contracts under your name however the OR will probably only allow one for your outgoings. Just put your mobile phone costs on the I&E and don't bother putting your sister's on the form as she gives you the money for this anyway.
As far as the OR is concerned you can keep the mobile contracts and there is no reason that they should contact Vodafone. I don't think that Vodafone check the Insolvency Register but if they do then they could cancel the contract if they wanted to. If you have kept up the payments on the phone then there shouldn't be any reason for them to cancel the contract so it should just be a case of carrying on as normal. |

Thanks for your help. Will the OR question the direct debit for vodafone being higher than £40.00 a month, as the OR will be able to see this from my bank staement. Would I just explain this to him/her that my sister has a phone under my name when they phone me for the interview? Also I currently have a basic only bank account with Halifax which my wages, tax credits, child benefit gets paid into, I do not have any debt with them do you think they will let me keep my bank account open or will they freeze it? I am worried about this as I get my tax credits paid toi me weekly and will need an account for them to go into. The whole process of bankruptcy is very scary, hopefully I will feel at ease once I have done it.

The bank is going to be a bit dodgy. I would highly recommend contacting them before you declare BR to see if they will let you keep the account open and that it will not be frozen once you are declared BR.
It may be worth opening a Co-op Cashminder account just in case there are problems with the Halifax account.
The OR won't question the DD being higher than £40. This is about the max amount that you will be allowed so if it is higher then the OR would expect it to come out of your DI.
The OR allows you certain amounts for each item (food, clothing, etc.) and if you want to spend more than this amount then it is up to you but it will need to come out of the DI. |

Even if the Halifax say that they will allow you to keep the account make sure that you withdraw some/all of the money the day before you declare BR as some banks still freeze the accounts and it can take up to a week to un-freeze them. |

Hi on the AOE, make sure you tell the OR at the first opportunity as if the money gets taken out it would be returned to the OR not you |

I had Halifax and letter i had they do not allow bankrupts to hold accounts i openned a co op account 1 month before bankruptcy i told them why and have had no problems with them what so ever.
Co Op online banking is a bitslow but i can live with that

There's a bit of disagreement between people as to whether you should put the Co-op account on the form. Some people say that you should as the form asks you to list ALL bank accounts. Others say you shouldn't as you can pretty much guarantee all account on the forms will be frozen.
I opened my Co-op account about 2 weeks before declaring BR and didn't use it until after I was BR. I didn't bother putting the account on the form but mentioned it to the OR during the interview. There was no problem with this and the OR didn't think I had try to hide the account or do anything wrong.
My recommendation would be not to put the account on the SOA but other people may advise otherwise. |
