The thing is that my work genuinely is decreasing due to the fact that I am returning to uni in Sept and that the extra hours that i have been doing this year are maternity cover for a girl who returns to work on the 21st September. I have the contract covering this so i can show the OR if need be. |

Good idea. Are there times when they dont bother with a NT code then?
I thought it was issued direct from the court on day of BR order? |

Not everyone gets one, its a case by case, if the OR Feels they can get a 12 month IPA from it they will if they feel its not worthwhile and they can get an IPA from your icome they will, if they feel that that isnt worthwhile too you can get no IPA.
You have to make sure your outgoings reflect your average outgoings and not those stated by government guidelines.

Ok I will try
You submit your outgoings as they are on average i.e Petrol for April was £50, then £60 for May and £90 for June so you would put your petrol allowance as £67
After you have detailed your allowances I would assume categories would be:
Rent, Housekeeping University fees Teachers Union fees Managed Bank account fees Travel costs Holidays Clothing Health - Optical and Dental Gas, Elec and Council tax Food Food for uni/work any extras
Once these are in place the OR would then look at your income, this for yo wuold be Student Loans, and Student Grants and your wage he/she would then asses if your outgoings are fair for both parties i.e if you put gas at £10 he may suggest £50 a month something like that.
Once thats all agreed he/she would then asses for an IPA you need to have a disposable income (DI) of over £100 for one of these after that its a 50/50 split ie. if your DI is £200 then the IPA would be £100.
If he cant get an IPA due to the income DI being below the threshold or becuae your are in a reasonable deficit he will leave your monies alone.
He will then asses if your tax would be worthy of an IPA, due to the costs of setting this up I think they look at tax of £70 an upwards. If you dont earn enough tax for this, or if your tax is unstable i.e because you dont have a contract for hours or some weeks you do 40 hours one week and 6 the next he would ask for a payslip of the last 3 months and P60 after all this he will the asses the tax situation if it turns out that you either pay no or little tax and/or during the last 3 months and the last tax year you did not pay a high amount of tax he wont place an IPA, he will however review this every 3 months until discharge, if you dont get an IPAA this could be 6 months (Early).
The OR will inform you whether you can get other benefits and as such ask you to goto a jobcentre or a CAB advisor for further advice.
If you dont agree with the ORs findings you can ask for it to be reviewed again after which it would goto a judge and they will make a final decision.

Rent - £377 Food - £ Housekeeping - £ Car Insurance - £23 Car Tax/Maintenance - £20 Petrol - £150 (I have to commute for work and a long way to uni) Mobile phone - £47 (its fixed at that price I cant go above) Clothes - £10 Holidays - £0 Gas - £35 Electric - £35 Water - 20 Hair/Dentist - £12 Dog Food - £20 Dog Insurance - £10 Uni fees - £271 (this is what the year works out split over 12 months) Uni Books - £10 (roughly £200 year)
Cannot think of anything else

Doh - also forgot food - how much? Just me no dependants ooooh and contents insurance is £6 per month and mobile phone insurance is £7 per month - are these allowed?

I would of put or would put, not sure if your OR has these yet.
Housekeeping £50 Remove dog insurance and food as these are in housekeeping
I would put £25 for books and provide course details Food put £150 Hair at £12 and Dental/Optical at £25 Mobile phone is a little high Have you sent these to the OR

Dont worry the OR and the OR Clerk are really nice people make sure you tell him that you got your outgoings wrong and that to include the above too

Thanks. I really dont want to do this! I want to do the IVA....
At least then I wont have to live with this forever - do you think im wasting my time? I would be willing to give up my degree and just get a rubbish job to allow me surplus income for the IVA because I want to avoid BK that much. |
