 Unexpected one off back payment in wages

Hi,

I was due payrise this month of around £80-100. However when I checked my pay last Friday I saw about £1000 too much, phoned up HR cos I assumed I had been overpaid and thy have just com back to me it is correct and that I have not been paid correctly i.e. wrong increment dates since 1 January 2008 hence this one off payment of back pay. Will the OR take this off me in it's entirety or will I e allowd to keep a proportion. I don't have an IPA/IPO in place as partner has no source of income. If I am allowed some it would be amazing as I have to pay my solicitor £300 this month for soertin out the transfer of my solely owned propoerty (means I won't have to ask my Mum)and my cr is on it's complete last legs don't think it has long before the old car graveyard and I had no idea wha wa going to do about that as I need it for work and looking affter my Dad.

Any advice gratefully received.

Hi Crockett

They should let you keep some of it. You can negotiate with them on the basis that you have things to pay for that you hadn't anticipated, and offer to give them half.

Thanks for the advice, hopefully I can negotiate with them a little. The thing is that I don't know exactly how much the back pay is until I get my payslip at the end of this month with my new wages on it. Should I wait till then to contact th OR or sould I let them know now?

I would wait until you receive your payslip as you can't negotiate on it properly until you know what it is.

My understanding is that they should let you keep half in any case and so if you have legitimate needs for the rest I would work these out first and then halve the remainder if you are making an offer.

Hi

If you dont have an IPA, did the OR say that he/she was interested in your income at all, I was on SSP from work and made my OR aware that I may get a severance package as it would come to a point when they would have to sack me, the OR Examiner said she wasnt interested

When were you made bankrupt? If you are discharged the OR has no call on this money if you are not subject to an IPA
