i am currently paying back an over payment of housing and council tax benefit, can i putthis down as a debt? it is for a previous property with a different housing authority to where i live now so payments can not be taken from my current housing/council tax benefit.

Yes you can put this down as a debt as long as it wasn't fraudulently incurred

It is only fraudulently claimed if you have admitted and signed to say so or if they have taken you to court to prove it. If they have just asked you to repay it without an acknowledgement of guilt then it is not proven to be fraudulently claimed

just to add, for most small amounts of a couple of thousand or less they usually dont bother proving fraud, it is only usually in large cases that they do

Hoe was it found out? I think if you corrected the error then it can't be classed as fraud but if someone shopped you & you were interviewed etc it probably would be.
