I was made bankrupt 2 years in September. This was due to unpaid council tax on th property. At the time I was renting my house out, to a tennet , and later found out she had not paid council tax on the property for 6 years. I only found out because the tenatnt had not paid me any rent in two months and went up to see her, and the house was empty, and letters from my trustee behind the door.
Spoke to the trustee who is hopless and keeps stressing this is my debt, and the house will have to be sold. I have been writing to them and foning for months and getting no replys. I just wanted to know is it possible for me to seel my house and pay off the debt, or will it have to be sold through them. I have put alot of work into this house , and if they sell it will I get any money back on this > Please advise me uregntly. Do not know what to do

Hi Lisa and welcome to the forum
How much is the debt in the bankruptcy? It might be better for you to raise some money against this property and seek an annulment of the bankruptcy - but you will have to pay all of the Trustee's and OR's costs. How much equity is there in the property?
The Trustee does have the powere to seek a possession order over the property, so don't underestimate their powers, and they have to do this within three years from the date of the bankruptcy order, so time is now of the essence if you are to broker a settlement. And you can sell your property directly, but the Trustee will need to be kept closely in the loop.
For an informal chat about any financial difficulties, or advice as to the options available, I can be contacted via my website - www.melaniegiles.com |

Hi I to have been made bankrupt by my council for non payment of council tax in 1994. I was 24 years old. I have just been appointed a trustee who has not contacted me, Should I contact them, Because I had credit cards and a loan all paid on time and only 1 year to off the loan left, these have been put into the bankrupt pot (as i call it) so now my debt is 7500.00 could they take my home off me? I only own half as me and my partner are not married?
