i have been served with statutory demand for £3200, now i do not own any assets but the house i live in, i sold to my brother over 6 years ago and i still hold charge on the property for some money on the property that my brother did not pay at the time, can reciever enforce the charge by way of asking my brother to pay back those debts, through the sale of the property or not?

Hi

if you are made Br then the Official Receiver would be the beneficiary of the charge.

They would contact your brother and seek repayment at an early opportunity, assuming that there is equity to do so.

Is it worth considering your brother reduce his debt to you by clearing the demand?
