The government has published guidance for councils on new rules requiring mortgage lenders to inform them of repossessions.


Changes to Civil Procedure Rules Part 55 – Rule 55.10 – came into force yesterday.

It means lenders must advise local housing authorities when repossession proceedings have commenced, in an attempt to prevent homelessness.

The guidance is not statutory, but ‘strongly encourages’ authorities to ‘apply good practice upon receipt of this information’.

It explains the information from the mortgage lenders ‘will provide an opportunity for authorities to engage with households and delivery partners proactively before repossession takes place’.

The document suggests this would help local authorities identify households that would benefit from the Mortgage Rescue Scheme and Repossession Prevention Fund.

‘The number of repossessions has risen during 2008 and early 2009, and may continue to increase in 2010,’ the document notes.

It continues: ‘The government is strongly committed to preventing homelessness and mortgage repossessions wherever possible and is delivering a range of support options for households struggling with their mortgage repayments.’

The Council of Mortgage Lenders found the number of mortgage possessions fell in the second quarter of this year – from 12,700 cases in the first quarter to 11,400 cases in the second (a drop of 10 per cent). But that was still 14 per cent more than the 10,000 cases of possession in the second quarter of last year.

‘There is a clear role for local housing authorities to help households in difficulty find the most appropriate options to prevent homelessness,’ the guidance says.

‘This may include homelessness assistance, advice on housing options, or simply referral to the most appropriate delivery partner such as an independent debt advice agency.’

hi housing,

can you please tell me where you read that document so i can download or get hold of a copy for myself.

i'm particularly interested in the statement - It continues: ‘The government is strongly committed to preventing homelessness.....

this is because (through no fault of my own) i will soon be homeless as i am being evicted from my home of 20 years (i'm told in several letters from the ministry of justice because of the financial implications of the government's decent homes standards 2010 - apparently flagship labour housing policy is making my family homeless!!!), and i want to present my local labour mp with the above statement and then ask him why he still refuses to help me and my family in this awful and unfair situation the moj / prison service has put us in.

i'd be grateful if you could post the link for me.

The particular document is called:

You should be able to find it - it is a reasonable web site to follow.
