ive just been o the phone to the halifax asking for an address to send my house keys, (went br in march) they have told me i need to take them into my local branch and fill in a "transfer of keys" form.....ive always been told not to fill in any forms from the bank but i need the proof of transfer so i can stop paying council tax.....what should i do?
Provided the "transfer of keys" form doesn't have a shortfall clause in it then there is no problem signing it.
The other option is to send the keys along with a letter saying you are voluntarily giving up the property for repossession to the Halifax recorded/special delivery. You can then get the signature of the person who signed for the letter from Royal Mail and this will confirm you have given up the property and Halifax has the keys.
No, they cannot force you to sign the form to take responsibility for the shortfall. I don't know whether the "transfer of keys" form has the shortfall clause in it but you should read it very carefully before signing as there is a very good chance the clause will be there.
