Dear Forum
I am 8 months into my BR and have a few questions I was hoping someone may be able to answer for me please!
1. What is the usual procedure for Discharge? (I have emailed my OR twice updating them of my new details and heard nothing back at all!). 2. Does everyone get a review before being Discharged? 3. What are the consequences of not updating the OR of a change in circumstance? 4. Is it worth contacting the OR if a change in circumstance is only temporary i.e. - 2 months? 5. Can the OR make you sign-on for JSA if you are unemployed / working P / T? 6. What is the minimum amount of Monthly Disposable Income to get an IPA?

Ok here goes
1)there are two ways to get discharge, firstly wait out the whole 12 months, this is automatic discharge and happens automatically, you receive no notification, the day just passes. The second is Early discharge where the OR makes an application because both he/she has finished the investigation and has not found anything to bad. It is usually considered impolite to ask for ED as it is at the OR's discretion and not a right.
2)You get a review if an ED is applied for or at any other time where the OR thinks it is needed, for example, if you told the OR that you were moving in 3 months you would probably get a review after 3 months.
3)anything from denying early discharge, suspending discharge, a BRO, up to in extreme cases prosection and imprisonment. ie if the change didnt really affect the bankruptcy then probably nothing would happen, if it denied the OR and creditors large sums of money then one of the more severe ones.
4)As above it depends on what the cahange is, ie if you got £50 extra for two months then probably not. If you got £5,000 extra for two months then maybe.If in doubt then tell the OR.
5)No
6)£100pm, but remember that is by the OR counting. |
