hi,
so pleased i found this site as i start off on my iva / bc journey,all advice and help welcome,
i run a fairly successful public house so a couple of years ago a friend and my self decided to take on a couple more , before we knew we had a mini empire (6 pubs)natwest throwing overdrafts at us , money was coming in and every one was getting paid , then the recession started to bite . overdrafts went uncleared the revenue not getting paid for vat and paye we tried but could not catch up.
we managed to get some debt such business rates and some utility bills put into our ltd company name , hind sight is a great thing and i know everything should of been but we didn't.
after been told by tenon that i could not qualify for a personal iva did not think to include all business debts that are in my name(muppet).rang the national debt advice line who said to put it all together and call grant thornton so i did and i have a meeting set up on the 5th of nov, i know i made mistakes but just want to be debt free and carry on running my pub.
i don't which is the best route iva or bankcruptcy as if i go bc punch state that i will lose my lease for my pub in which i live with my family and would love to stay here.i have had an offer from a friend who said i could reassign the lease to him and then transfer it back to me in a year,i thaink punch would go for this as i have never been late with rent or sales payments.
but i have a business loan with natwest and i dont know if they have a charge over the lease and if they do what repercussions there could be, it all very complicated and i feel such a fool for taking a chance with these other businesses.
all replies welcome and looking forward to sleeping at night again and enjoying a stress free family life.

your situation sounds quite complicated and i would suggest and recommend that you talk to Paul Johns from RevivaUK www.revivauk.com he is one of the forum experts and will be able to offer pertinent advice free and over the phone.
he has a lot of experience with people like yourself in the licensed trade.

Hi, the problem with transfering the lease is that it is worth something as it is up to date (i presume you paid for it in the first place) plus all the stock and any fixtures and fittings (if you own them yourself). If you go bankrupt after having transfered it for nothing he OR will want it back
