im in court next week. I have opened a co-op cashminder account and have been using it for some time now. I have just moved the payments of my CSA , child benefit and tax credit to this account aswel. On wed next week (same day as im in court) my tax creds will be paid into this account - will i still be able to withdraw it , will they "freeze" my account or anything ? My rent comes out of that account by standing order on Friday when my wage from work goes in ? Will all these still go ahead ?
Just wondering if i have to draw all money out that i need incase its temporarily frozen or something. No sure what happens. I dont have much in there. Just about £300 which is for rent / nursery fees etc etc , all accounted for in relation to bills

Hi Lyndsey, if you have no debts tied to the coop account then there is no need to put it on the BR form. Just mention you have this account to the OR when you have your interview then there is no chance of it being temp frozen.

no there are no debts at all with this account , none with my tsb account either but i was advised to get the coop one just incase tsb did close my account even though i owe them nothing |

Yes the coop and barclays are two banks that offer basic bank accounts to bankrupts. I have had no problem with them at all and most people on this site seem to use coop.

oh good so no need to start panic withdrawls from the cash point to make sure i empty it before wednesday ( not that that wold take long to do!) was just worried about withdrawing money for rent and childcare and shopping etc but if they arent going to freeze my account or anything thern there is nothing to worry about |

I know it is easy for others to type and say every thing will be OK but .... every thing will be OK
The OR and court clerks are very helpful they have a responsibility to the creditors / court process but they are also sensible people that understand that you need to eat, pay rent etc.
their may be a slight delay between OR releasing account and you using it (my wife was about 15 mins), if you are worried about them seizing an account and you need the money for bona fida living expenses. Do your normal family shop the day before you go BR !
keep the receipt in case they ask (which i doubt) but you can then show that it was for normal every day essentials

Lyndsey as I mentioned earlier dont put the coop account down on the bankruptcy form and then there is no chance of it being frozen.

As others have stated, there is no need to list the new co-op account on the forms, just make sure you have transferred salary and any DD's regarding your home to the new account (and not anything for your debts such as loans or credit card payment dd's) when you have your chat with the OR mention the fact that you have openened a new account and provide the account details at that time. The OR will be more than happy that you have done it this way as it saves them the hassle of having to 'unfreeze' the account

i am not the site expert (s) but i would say declare the coop accounts
section 5 of the BR petition asks for all banks accounts and credit cards a section is available to "tick if your regular income is paid into this account" you also declare the balance of the account at the time of applying to go BR
i think that it was clarified earlier in the text that ONK does not owe the co-op money, the account has minimal funds the Or provides the warning that
if you become bankrupt it may be possible for the OR to ask your bank or building society to release some or all of a credit balance to you if it is required for your domestic living expenses.
coop have proven track record of helping BR |

I opened the account upon the advice of my expert who will be attending court with me, He has already taken the bank details from me.To be on the safe side i will try and make sure i have enough money to see my by for food and fuel to get to work etc. So will they freeze it as they will know about it !! I have a 3yr old child and im on my own with him so worried that i will be left with my money i have in there being taken off me or made unavailable. It is money set aside for my rent and childcare and a little i have managed to save for christmas. Sureley they wont take that from me ?? Its no more than about £150 over what is to be paid out for my rent. |

Hi
After court I am sure that your expert will walk round the corner to drop your file over to the Official Receiver, and have a quick word about the bank account.
I haven't had a COOP account frozen yet ( excluding the Brighton OR )
They know that you need an account to receive salary, and child benefit etc.
I am 100% sure that the money will be fine, otherwise I will cover any loss myself.
