I am seriously considering declaring myself bankrupt however I have 1 question unanswered. My Wife is a Thai living in Thailand. I have been staying there with her and my daughter for the last 2 years coming to England once a year to obtain a tourist visa. I am not officially a resident of Thailand - only a non-immigrant visitor. I have been staying here because it is a lot cheaper than living in England and was hoping that my business would start making money again then I could return. However due to this long recession this has not happened and I am now almost broke. Will the fact that I have been here so long affect my ability to become bankrupt? Thank you

not yet but once you have been resident in thailand and not trading in the uk for more than 3 years then you would not be able to declare bankrutcy in the UK, so if you are going to do it then it would need to be this year

Hi Stuart

subject to you qualifying for BR in the UK as per debt info guidance, you can either self petition or ask a third person to obtain a lasting power of attorney and petition on your behalf.

Paul and his team at Reviva do attend the High court and help overseas expats with the LPA.

somne districts and courts are tightening up on overseas applications and being very strict with time lines, I would suggest speaking to one of the experts to make certain you are fully aware of all the time frames and conditions .
