Hi. My wife was made BR in January this year and she is hoping for an early discharge.
While on holiday this week she had a nasty accident which left her injured and was not her fault.
She has a solicitor coming round next week to interview her about the incident and hopefully making a claim against the company involved.
What we would both like to know is would she be able to keep any money from the claim as it will probably take a while to sort out and she should be dischagerd before any outcome or should she wait until discharged before making a claim.

Any personal injury compensation is exempt from the BR so even if you receive the money while BR you will be able to keep all of it.

If the accident happened after the bankruptcy date then it is your right to take the claim forward. (if the accident was before the bankruptcy order it is more complicated). If you receive any of the money from this claim after discharge it is yours to keep,If you receive it before dischrge you get to keep the personal injury part but could lose some money that is compansation for non personal injury claims
