Hi everyone and Bigal. (Happy New Year to all!)
I'm now nearly 7 Mnths into my BR and I just wondered if my case is sitting on a shelf somewhere until I get discharged..? I'm under Brighton OR office and since my OR interview (May2010) I haven't had any communications other than from Moon Beever which is now running smoothly with the NIL tax code etc.(no other IPA) My debts where all over 6 years old and I also had over 5 year DMP before declaring BR-which stood in good favors with the OR I believe:). My OR interviewer sounded genuinly astonished that I hadn't applied for any loans for well over 5-7 years prior to declaring BR. She also said I would be recomended for early discharge, but would'nt get any letters regarding this-just check the Insolvency site.
As you have had actual OR office experience I just wondered if you had any views/tips on this?

yep, it will be on a shelf somewhere, either waiting for ED if they are doing them (which they may not be) or waiting for AD,
sometimes no news is good news |

Hi and happy new year as well, when the court makes the local OR office aware of a bankruptcy, there will be a lot of activity by that office carrying out initial enquiries, land reg searches etc, and making contact to arrange an interview.
After the interview, the examiner has a report to creditors to put together, plus any instructions given to the case clerk for anything from IPA's to dealing with insurance policies, cars etc. Providing there is nothing complicated, and all actions completed the file will then sit on a shelf for a while awaiting what is known as closing.
By closing, this means that there are no more actions needed, and that the case can be closed and sent for storage somewhere in Essex I think! Up until the IPA changes that would have been it, as the insolvency register updates when the 12 months is up for AD. However, with the IPA changes, the file will stay on a shelf(athough the IS is in the process of making all processes paperless), until an IPOQ gets sent out prior to AD, unless of course it is apparent that the persons financial position is such, that there will be no possibility of an IPA(i.e. all income derived from benefits).
Hope this gives an insight to what happens!

Hi Bigal and thanks for reply.
Never been on land registry, rent where I live, approx £1000 pr mnth salary with little hope of changing and definately left with way less than £100 each month after all bills etc. The OR sent me a letter that my car is exempt as I need it for work and its not of great value.
I'll keep taking deep breaths and hope time goes fast til AD

So sorry, I forgot to ask this question:
I seem to remember that when the OR is finished investigating a BR case, it (as everyone says) sits on a shelf somewhere waiting for either AD or ED.Somewhere the RTLU comes in....what do they do...? And how long do they work on a case like mine where I have no assets, rent and my car has been deemed excemt and my debts were very old-over 6-7-8 years when declaring BR etc?? |

Hi, if you have no assets, nor an IPA that needs monitoring, your case will remain with the OR until either an IPOQ(income payments questionnaire)is sent out prior to ED, but as 7 months have elapsed I would hazard a guess that the next thing you'll get is an IPOQ prior to AD under the new IPA rules.
Providing there is no change (no assets, no IPA etc) then AD will follow, and the case will be closed.

Thanks very much for your advise/help.
7 Mnths has gone relatively fast so I will look forward and hope the next 5 goes fast too. I so want to get on with my life :)
