I WENT BANKRUPT IN MAY 2009,I USED THIS SITE LIKE A DAILY NEWSPAPER, :FANTASTIC: I HAVE ONE LAST QUESTION FOR YOU. I WAS CONTACTED ABOUT MY TAX PAYMENTS TO O.R BUT NEVER GOT ANYTHING IN WRITING, THEN A FEW MONTHS LATER MOVED HOUSE AND HAVE STILL NOT HAD ANYTHING, I DIDNT TELL THEM I WAS MOVING AS ABOUT 6 MONTHS HAD PASSED AND HEARD NOTHING FROM O.R. WELL IVE BEEN SITTING ON £4000 + NOW SINCE THEY LAST SPOKE TO ME IN AUGUST 2009. ALSO I DONT KNOW IF IME DISCHARGED FROM BR. I ASSUME I AM? AT TIME OF BR IT WAS SCAREY BUT NOW IVE MANAGED TO START BUSINESS AGAIN AND IME BACK ON MY FEET ALMOST, BUSINESS DOING WELL, BUT WHAT ABOUT THE 4K AND AM I STILL BR. THANKS FOR ALL YOU PEOPLE ON HERE WHO GOT ME THROUGH IT, ( TOTALLY DEBT FREE) NEVER SLEPT SO WELL. |

Dear RGM
Before you do anything, you had better check the Insolvency Register to see if you have been discharged from bankruptcy! You have not told the OR of your move and he may be unaware. It sounds as if this may have happened during your bankruptcy period. You are supposed to tell the OR of such matters.

Yes you need to tell the OR that you moved, you should have done this at the time |

Hi Debtinfo ,seems ages since i posted on here about my hubby going bankrupt infact its a year today 14th Jan 2010 when he filed , we cant believe a year has past and this time last year he was very much a worn down man ! but a year on life is so much better a year on . Just wanted to ask about discharge , so is he automatically discharged a year to the date as we have heard nothing since mid August 2010 after the OR accepted a settlement figure from the equity of our joint home, this was paid and they wrote saying they accepted the payment and were happy and no IPA/IPO was set as they were satisfied with our I&E and since then we have not heard anything so does that mean its the end !!!!!! also how long does his name stay on the register . thnxs for your help

yes discharge should be after 1 year, you can check on the Insolvency Register.His name stays on there for 3 months after discharge |

Thanks for your prompt reply , so will he recieve a discharge notice through the post ? and im i right that no IPO/IPA can be set after discharge as he has been offered overtime but declined it if all he is going to do is pay it back to whoever !

Hi worriedwife, you don't get any notification of discharge through the post, it just happens, check on the insolvency register.
Also once discharged, an IPA cannot be set up. with regards to the house, have you checked Land Registry, to see if the restriction has been lifted?
Big Al Insolvency examiner with the Insolvency service from April 2008 - July 2010.

Sorry i sound thick ! so is the discharge official after 1 year just automatic ? and where do we aquire an official document to say he is officially discharged . he went bankrupt 14/1/10 so will it end 14/1/11 or not untill name removed from register ! im confused lol

hi also there were no restriction on the property as i bought my husbands share of equity before bankruptcy and i gave them all details and account with the equity relased they accepted this and i released the monies to them in august . They sent a letter back for reciept of monies saying they accepted this as a full & final settlement and they were not looking at IPA/IPO as they were happy with I&E . Since then no request for earnings or bank statements ect have been asked for, but our financial position has not changed so we have just kept our heads down hoping for the end in sight 14/1/11 . he just doesnt want to go and earn any overtime now and they come back on him .

Hi worriedwife,
Check the insolvency register, he should now show as discharged.
You have to pay for a formal notification.
The entry will stay on the register for 3 months so I suggest you print off a few copies incase you need to show anyone.

Hi, Thanks to everyone , I have found this site so so helpful , over the last 2 years i have read so many threads on here and learnt so many things and one thing i did learn was there are so many people in the same situation as my hubby and its not an easy time ,but there is light at the end of the tunnel so face up to your demons and your half way there ! be honest with the OR and they will treat you very fairly . thanks

hubby is no longer bankrupt.
entry also on other thread but repeated here
i would suggest that you print off a number of copies of the discharge notice, it will remain on the insolvency web site for 3 months,
Most creditors will accept this notice. if you do not obtain a print out from web site you will have to go to court and pay £90 for the same information
