Hi All,
Hope someone out there can help when filling in SOA a thought occured to me, one creditor is local council - business rates aprox £4500 outstanding. If they start to threaten and turn nasty shall I tell them that I am filing for BR in 3 or 4 weeks. Also what powers do they have that are different to other creditors, I think I need an expert on this one, just have it in my mind that I can't ignore their letters etc.. |

Have you had a court summons yet? The council are usually quite quick to get these for commercial rates but it does take time.
You will also find that if you then explain that you are going through insolvency and give them a court date they will usually hold action until after the date BUT you must remember to call them with the Br number afterwardsw

No I havn't received a summons just letters aying I have to bring payments upto date or will loose right to pay monthly just worried baliffs could turn up unexpected |

might be courteous to phone and tell them though to0 stop further letters

The local authority has powers to distrain over your assets which are not available to other creditors, and when there is a whiff of insolvency they tend to act pretty quickly.

Hi foxbat - so is it worth ringing the court and getting a confirmed date? You can then give the council some definite information and hopefully prevent them taking any action in the meantime. Or...will this kick them into action as Melanie has suggested??? What do BR assist experts think???

Hi again Vicki Yes that was my worry too, I've already checked with the court and it's just a turn up on the day no appointment needed, but I need a few weeks to save up some money for fee.
Think I can keep all others at bay but worried about commercial rates, they don't seem to be very understanding or helpful.
I just think I've got everything stright and then something else crops up but thanks to everyone on this forum I don't feel alone anymore. |

No you're not alone - it's only a few weeks to wait but you need it to run as smooth as possible.
It's a tricky one - do you sit tight for a few more weeks or do you tell them you are going BR and hope they don't jump into action? I still think they won't have time to do anything in court before you do. Maybe leave it til a week before going BR and then tell them so definately won't have time to do anything but you done the right thing by informing them???

they can send the bailiffs round but they still need to go to the magistrates court and get an order against you.
Perhaps it is different in your area but I have always found them reasonable people PROVIDED that you give them a date.
If it is within 3 weeks it is highly unlikely that they can get to court before then. You will also find that after the court judgement then it takes a few days to get to the bailiffs then they write to you to let you know they need the money within 10 days before visiting.
My feeling is that you have time.
