thanks for previous replies, hadn't quite got the hang of this and entered twice plus I think I tried answering myself which wasn't particularly helpfull. I am intending to go to court again on the 17th so am trying to complete the paperwork again. I am confused about who to put in " list of unsecured creditors" originally they were credit car company's Santander MBNA etc but they have been passed on to debt recovery and collection services who now contact me. Who do I put? and also the form asks for Date Incurred. I understand what to put for a loan but what date do you put for a credit card that you have had for years and always paid off before disaster struck? Again "what was the debt for?? A loan, yes, house improvements but how do you fill that column in for a credit card. sorry this is so long winded but I am desperate not to be rejected again. I feel enough of a failure without not being even able to go bankrupt properley.

If you have had your application refused once, it could be a sensible to speak one of the forum Experts and ask them to take the pressure off you and complete correctly all of the forms.
yes may be a small fee but sometimes having someone else to help is the correct answer.

Thanks Richard but it was refused because I took £450 not knowing it had gone up to £525 plus I was told I would be exempt from the £125 and it turns out I am not. My C.A.B. lady was really sweet but not quite up to date. The clerk didn't get as far as going through the whole thing. I had filled in the details with the original creditors however I have read something since which has made me query it and not to put too fine a point on it I really don't have enough for even a small fee. I have to take my train fare to Norwich court out of my electric money as it is. Thanks again though. |

Hi Janey,
Basically there are two possibilities
1) the debt has been sold on, then you put the debt coleector.
2) the debt collector is just colling on behalf of the lender, therefore the lenderstill owns the debt, and then you put the original lender down
Failing that if in doubt put both down, you cant have too much info, and your petition wont be refused on that basis |

and have just noticed I didn't spell properly, properly, is there no hope for me. Thanks for reply, I will put both as reading the letters I can't work out what is what from them. I also have loads of supporting paperwork, i.e from the sale of my house etc, shall I take everything I have in a seperate file or wait and see if the OR,(crikey can do the lingo now too) asks for it? Thanks very much, have felt pretty alone with all this up until now, such a scary place to be and try as I might I can't get my cat interested.

Don't take any of your creditor letters and paperwork to court, wait until the OR asks for them.

re Norwich CC, it is a drop in court first come first served basis be as early as train allows because although BR is important to you it is actually low on court priorities and you will be fitted in as and when !
The total fee is £700.
Norwich Court cafe downstairs you then go upto District judge waiting room, expect chaos.
normally see D. Judge both very nice, one of the judges is probably nicest judge on the circuit he does not care that much about the forms he just wants to make certain that the individual is OK and it is the right thing for them, in doing so he spends about 5 - 10 mins with you.
The other is very quick and a process of rubber stamping the application

thank you Richard, that cheers me up a lot and I am really glad to know about cafe too. Last time I went apart from setting off the alarms and having to get half naked before they would let me in (not attractive) I spent ages hanging about in the car park smoking damp roll ups. Hope I get the nice one, mind you any will do, I just need to get it over with. Many thanks again.

I surely will. Right, I have just finished all paperwork and apart from having to re print 2 pages I spilt coffee on and one my cat Sweets dismembered some poor thing on over night (I live on a boat and am rather space deficient at times) I believe I am ready for Monday. Hope I am posting on Monday night that deed is done. Fingers crossed and luck to everyone else.

The thought of your cat dismembering something is making me cringe! Luckily Harry (my cat aka my baby!) doesn't do that too often, although he is quite keen on a frog occasionally!
