My partner may be going through a bankruptcy. If he is paying me his half of the rent will they chase me for the money he is giving me ? After 3 years, is my partner still liable to mortgage repayments in a joint mortgage ?

Hi and welcome.

Your partner will be able to pay you his share of household expenses.

As regards the mortgage, is it still being paid? If so then he will always beliable for the payments. If the house is repossessed then any shortfall will come into the bankruptcy.

The House with the mortgage is basically my partners which he bought with an ex! They split up then she went bankrupt 6 months after it was bought. My partner has been paying the mortgage on this house all on his own after 4 years as northern rock refused to put the sole mortgage in his name if he bought her nbeneficial interest. He moved away got tenants in to assist with the high mortgag. now her bankruptcy is discharged after 3 years she has been saying that she doesn't have to pay anything and is claiming she has a right to give him an offer to buy her out, this house is in negative equity by 20k!! and she is now blackmailing!! Help please should she be paying for mortgage payments even tho the house was never reposed. How can she have legal rights but not be expected to pay anything for this?? Does she has a legal right?? There have been other bills with the property too which se has never paid for? . My partner is stuck and doesn't know what to do as she is saying cos she declared the house on her bankruptcy she can only benefit from him paying her out or if there was a profit and that any bills and negative equity she isn't liable for!! is this correct? It now looks like he may have to face bankruptcy! Hence my concern with regards to rent as he lives in my house!, please help this is such a bad situation and we have no where to go

Hi Sara,

If his ex didn't sign a new mortgage deal with the mortgage company, then any shortfall arising from a repossession of the property will be written off in her bankruptcy, but your partner will be liable for the full amount of any shortfall.

If your partner wants to give the house up, then it can be repossessed and included in bankruptcy, if that is the option he chooses.

I advise you tell your partner to contact an expert on here to chat all of this through.
