Hi I have been paying a liability order for council tax, via council online bill payment, they wanted me to deal with harassing bailiffs and I refused, I pay £50 per week on a friday. They insist it takes 5 days to clear for the Friday.Orginally agreed £200 per month - same deal as £50/week, they complained about this after 6 weeks as not there on time so bailiffs sent threatening letter again, told council to get their facts right, all monies had been paid up to date.They asked for next payment last Friday - which I did. Now get letter today, from bailiff - Newlyns, saying they are taking bankruptcy action against me ???? Thought only could be from the councils solicitors, and how can they if I am paying them, plus - I am paying this years bill on top by direct debit each month?? Any advice |

If you have a debt which is not paid as it falls due ( and at this stage the whole amount is legally due) then the creditor can make you bankrupt. Im not saying that they will go through with their debt, it is impossible to know that, but they are legally able tomake you bankrupt as the full amount is due and you are not able to pay it |

Don't you need a minimum owing of £750 to be made bankrupt?

Just thought I would as the OP hadn't mentioned the amount of their debt, also in case there's others reading.

I have been paying this they agreed to £200 / month or £50 / week, yes its over £750. The letter is from bailiffs and not the council though, they are being picky about when it gets into their account, thanks for repsonses |
