 Will I have to sell my home to clear girlfriends debt ?

My girlfriend had been living with me the past 2 1/2 years in my house (title under my name only) and I have paid all bills and mortgage as she did/does not have a job. She has only recently admitted to debts of £32k on credit cards which I thought were a lot lower. I was paying towards some of this debt and she was also getting help from her family. Her family no longer can help and she may have to claim for bankruptcy as I cannot sustain the debt. My concern is if they can sell my house to pay her debts? As I said she did not contribute to the payments of the mortgage or the initial deposit which came from my own funds. However my concern is that we did have a joint bond prior to me buying the house. I can prove the funds in this account came from me and she did not contribute to them. In fact there is a paper trail to prove the funds came from the sale of my property overseas and an overseas bank account, which then made up the full funds in the joint bond.I am however concerned that as her name was in the bond this will in effect mean they can then claim these funds had also belonged to her and as this money was used to buy the house, they therefore will have a right to sell my home to clear her debt, even though her name is not on the title? Please can you let me know where I stand on this?

Hi and welcome to the forum.

If the house is in your name and your girlfriend has not contributed to the expenditure at all then it should be fine.

As regards the bond, if you can prove that all of the funds came from yourself then that should be fine as well.

Hi Loz,

It sounds like your gf does not have an interest in your property so it will not be at risk if she declares bankruptcy.

Make sure she takes proper advice from an expert on all her options.
