Hi CS that all depends on a number of circumstances. How long has your husband lived at the property? How long have you lived at the property? Who paid the deposit and from what bank account (his / yours / joint) ? Who pays the monthly mortgage and from what bank account (his / yours / joint)? What is his contribution to the household expenditure each month? What is your contribution to the household expenditure each month? Is there a mortgage on the property in the first place, and if not was the house paid for before you moved in?
All these things have an impact on whether or not the Official Receiver, or a trustee, could argue that you have a proprietary interest in the property.
