I have a couple more questions and would be grateful for any help

1. I have an account with Next Directory (catalogue). I ordered some clothes out of the catalogue weeks before my husband and myself even discussed bankruptcy as an option to our problems. I have been unable to pay any instalments since I ordered these clothes. Will I get into trouble for this? Should I make a token payment? (we haven't actually gone bankrupt yet). I just don't want it to look like I ordered these clothes knowing full well I was going BR, because this is just not the case.

2. I just had a phone call from HSBC (Mastercard) wanting a payment, which I cannot make. They said that I have some funds in another HSBC account and could I give them authorisation to take the funds from that account to pay the Credit Card. I said "no", as to be honest I am not sure if I can authorise that at this stage....We are going BR in a few weeks time. Also when the guy asked me why I was going BR, I told him it was none of his business. Am I obliged to tell the creditors the reasons why we are going BR?

as far as i know you do need to tell them anything at all, sorry i can not answer your question's but i'm sure that somebody will soon,godd luck for the future and keep posting

Hi snow dog,

No you dont have to tell your creditors why you are going BR its non of there business as is the case you dont even have to tell them that you are going BR.

As for Next i would not now make a payment if your close as this could be seen as preferential treatment, i think thats right.

With the mastercard again dont authorise anything as this too will be seen as preferential and the OR if they wanted could overturn that anyhow.

Thanks Jo and Eammon. You have indeed been a help. I didn't think that I had to tell creditors why I was going bankrupt. I think my biggest worry (at this stage) was Next Directory. I had every intention of keeping up my payments back when I ordered the clothes, but things started to go wrong a few weeks later and I just could not make those payments.

When is it your going BR, you have said its soon.

i meant to say in my previous reply that next were one of my creditors and they passed my acc onto iqor collection agency who were a compleate pai until i told them that i was going br (but not why) and then they left me alone except a call once a month ( it took me several months to save the fee)

Hi again

We are going BR probably first or second week in November. We haven't got the dates finalised yet, but should be soon. We are actually moving into rented accommodation at the begining of November and wanted to get that out of the way first. Also we had a shop which we wanted to get sorted out and finished with before going BR.

I have to admit at this moment in time rather than dreading going BR I am actually relieved we came to this decision and even though I am a little nervous I will be happy to get it over and done with. I think the main thing of worry to me is the OR interview. But after reading some of the posts here it doesn't appear to be too bad!!??

No i did not find the interview that bad, it was the court that worried me although after we had been it was not that bad at all.

It will all be fine, honestly and before you know it you will be debt free.

Snowdog,

Good luck.

Along the same lines as the post from RHB, I suggest the following course of action to give yourself peace of mind:

Write a recorded delivery letter to the catalogue people stating that you have found you cannot afford the clothes, will not be able to make payments and feel it is a responsible thing to offer to return them. If you want you could tell them you are about to petition for your own bankruptcy but, really, all you need to say is that you have debt problems which you thought you could manage but realise that you no longer can and are looking at options to deal with your debt.

Chances are it might be quite a while before the company replies to you. If they do reply before you go BR they may ask you to return the clothes but, as they are clothes, they may be quite useless to the company second hand. The point is that if the prverbial hits the proverbial with the OR investigating the transaction later you can show that you endeavoured to return the items and did not just intend to keep them.

It is important the letter goes recorded delivery as you may wish to refer to it once you are bankrupt to show you attempted to rectify the purchase by returning them.

It could be great if you could make the intitial payment by cheque or postal order and put it in the same envelope as the letter (refer to the payment in the letter, of course!) phew!

one quick point: the OR will tend to look less favourably on recently incurred debts than on older debts. Also, it is important what amounts are involved here. I hope it isn't 20 fur coats we are talking about!

Snowdog,

the OR may want to look at the details of any application form which was filled out for the catalogue or any online application made or any telephone application made to them. The OR could approach the company for information or yourself.

As stated, though, a lot may depend on the amount involved. The potential letter offering to return the garments could, in my opinion, only go in your favour.

Hi Snowdog as RHB has just said you could try that and see where you stand.

I had made payments to mine before we started getting into trouble with them so i hope that you can get yours sorted out.

Like RHB has said show willing and see.

I have had the goods since July/August time....it was early to mid september that we realised we couldn't go on like we are, but I had already missed a payment to Next and now I have missed two.
