I went BR in May 2008. I only have an IPA for the Tax i am not paying due to NIL code.

I have received a letter that advises that I can get ED automatically after 12 months but this can be less in certain circumstances and before they decide to file a notice of ED in court they want to check if my financial circs have altered to see if I am now able to contribute via an IPA.

They have stated that I should complete the questionnaire and then they will write to my creditors to let them know I may get ED to se if there are any objections.

I just wanted to know if they were thinking of giving me an ED does this mean they are not thinking of a BRU or other.

As I said in my other post, get the forms back within the 14 day deadline and you'll get an early discharge.

Without wanting to sound pessimistic, just because you've had the forms doesn't mean you'll get ED - I've read about several people who this has happened to.

Obviously I hope that you do get it, but I'd send the forms back and forget about them until you hear!

The only reason you will be denied an early discharge is if (a) one of your creditors raises an objection, or (b) the OR receives a complaint about you.

I've also heard that you might not get it if the OR is too busy to process it.

I guess in theory that is possible, but I've not heard of a case where that's actually happened. Sometimes, it could take a couple of months, but it usually comes through!

I havn't been on for several months due to illness caused by anxiety over my bankruptcy. Anyway back in October I did a posting about a letter I had received fron OR about early discharge.

I sent the letter back within the 14 days but did not hear anything so I started to worry that something had gone wrong however this morning (31.01.09) had a letter informing me that I was discharged on 01.12.08 so all that wory was for nothing.

I just wanted to say thanks to everyone, Julian, Skippy etc who have guided me through this really tough time.

Can any one tell me when my name will be taken off the register.

Jenny is right, your name will be on the register for 3 months from the date of discharge. Make sure you print off the page showing that you are discharged as you may need this as proof of discharge in the future.

The only time I've been asked is when I tried to open a Sainsburys savings account, and they insisted they had to see an original certificate of discharge. I don't have it, so didn't bother with the account.

I'm pleased I didn't have one really as I've since found out it's their policy to destroy the certificate when the account is open!
