Hi guys
I have two shih tzu dogs and two newfoundland dogs would I need to inform the OR of these and is there chance they could be taken off me?
I also have a horse, would I need to do this also? and is there risk of this being taken
all my pets I paid cash for and have never had credit for them? |

How much would they be worth? Don't think it matters if you bought them on credit or by cash, just in terms of them being an asset. |

shih tzus are currently selling for £250-£350 Newfoundland currently selling for £1000 and the horse I bought approx 2 years ago for £5000 |

Hi
the dogs would be classed as family pets and as such are exempt ( unless you are a professional breeder) , however the horse situation is different and will be viewed as :-
1. it is an asset work £x ,000 2. it represents a significant ongoing monthly costs, which the OR could take instead as a contribution towards the debts via an IPA
From the sound of things you have a significant amount going on with the franchise, lease, fixtures & fittings, animals, staff etc etc etc
have you taken any professional advice yet from the helpline or another assisted bankruptcy expert?

Hi
I have left several messages in the number but never had any call back? just persume they are on holiday. I went to citizens advice the other day and they werent much help and just said to go bankcrupt |

They may be on holiday or just really busy

I also own a horse and we were told that we had to be able to prove that the horse was mine and not my husbands as it would be classed as an asset and a sale could be forced. We have 2 dogs and 2 cats as well and were told they would be classed as pets and exempt as they were not pedigree and had little value.
My horse is valued at about £800 at the sales (which is what they would do with him had he been my husbands). We are lucky that we are able to prove without a doubt that he is mine as my husband has never had any interest in horses. We also have a pony that is my grandsons and stays on our land. We have been told we need proof that my husband has no interest in either.

I have 2 pedigree cats, they cost £300 and £450 respectively but they are pets and the OR never mentioned them at all, we were allowed £20 per month pet allowance in our I&E and that just covers the pet insurance and we had to use any surplus for their food and litter costs. |

If I had a pedigree cat or dog I wouldn't have mentioned it - they are part of the family and not an asset as far as I'm concerned.

I agree skip, i dont have any pets but when it comes to like you have said pedigree dogs or cats then they are clearly family pets and worthless in a families eyes.

Hi
there are lots of things that you can do quite legitimately prior to Bankruptcy but they must be legal and transparent to the OR.
On the forms it will very clearly ask you to identify assets and you will by signing the document be committing a serious criminal offence if you knowingly mislead the OR.
Once you petition for Br than you are no longer in control so it is always better to make sure all your ducks are in a row before

the or will not allow you to fund the costs assosiated with the upkeep of a horse for a start.If the horse was say worth £800 and you could prove this then the or may let a member of your family buy the horse from the or but again how would you fund its keep out of basic living expenses allowed by the or.Dogs are pets you will be allowed probably £20 a month to feed and look after them you won't have to sell them as they are domestic pets unless you are a breeder. |
